SMS Compliance Policy

Purpose

The purpose of this policy is to ensure that all SMS communications conducted by Curenta comply with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and other relevant federal and state regulations.

This policy applies to all employees, contractors, and third-party vendors who engage in SMS communication on behalf of [Company Name].

Policy

  • Opt-In Requirement: SMS messages shall only be sent to individuals who have explicitly opted in to receive messages. Consent must be documented and retained.
  • Clear and Conspicuous Disclosure: At the time of opt-in, recipients must be clearly informed of the nature of the messages they will receive, the frequency, and any potential costs.

3.2 Message Content

  • Identification: Every SMS must clearly identify the sender.
  • Opt-Out Mechanism: Every SMS must include an opt-out mechanism (e.g., “Reply STOP to unsubscribe”). Opt-out requests must be honored promptly.

  • Timing Restrictions: Messages should not be sent outside of the hours of 8 AM to 9 PM local time of the recipient unless specifically requested by the recipient.

  • Opt-Out Records: Maintain records of all opt-out requests and ensure compliance.

3.5 Security and Privacy

  • Data Protection: Ensure the security and confidentiality of personal data collected for SMS communications.
  • Privacy Compliance: Adhere to all applicable privacy laws and regulations regarding the collection, storage, and use of personal data.

3.6 Monitoring and Enforcement

  • Compliance Monitoring: Regularly review SMS communications for compliance with this policy and applicable laws.
  • Training: Provide training to employees and contractors on SMS compliance requirements.
  • Enforcement: Violations of this policy may result in disciplinary action, up to and including termination.
